Interpretations of Shanghai FTZ Arbitration Rules Released

On 8 April 2014, the Shanghai InternationalArbitration Centre released its Interpretations of China (Shanghai) Pilot FreeTrade Zone Arbitration Rules (hereinafter called Rules). The Rules consists ofmany institutional innovations that aim to establish Shanghai as aninternationally influential international commercial arbitration centre. Thearbitration rules will take effect on 1 May 2014.

The interpretations analyse theinstitutional innovations in the Rules in three aspects—keyword definition,current domestic and foreign situations, and interpretation of innovationpoints. The institutional innovations include improvements in interim arbitrationmeasures, the establishment of emergency arbitration courts and the arbitrationcourt open list, elaboration of consolidated arbitration, inclusion of thirdparties in arbitration, reinforcement of the evidence system in arbitration,improvements in the combination of arbitration and mediation, introduction ofthe amicable arbitration system, and creation of procedures for disputesinvolving small amounts.
